DecoHarmonie Terms of Service

These Terms of Service ("Terms") govern your use of the DecoHarmonie website (the "Site") and the purchase of products from [Your business name] (ABN [Your ABN]), registered at [Your registered address] ("DecoHarmonie", "we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. Nothing in these Terms excludes, restricts or modifies any consumer guarantees that apply under the Australian Consumer Law (ACL).

1. Acceptance of terms

By browsing, registering, or purchasing from DecoHarmonie, you confirm that you are at least 18 years old (or have parental consent), have the legal capacity to enter into a binding contract, and accept these Terms in full.

2. Account

You may create an account to manage your orders. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at info@decoharmonie.com if you suspect unauthorised use.

3. Pricing and GST

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Prices may change at any time without prior notice, but changes will not affect orders that have already been confirmed. Shipping is free within Australia (see our Shipping Policy).

4. Order acceptance

Your order constitutes an offer to purchase. A contract of sale is formed only when we send you an order confirmation by email. We reserve the right to refuse or cancel any order, including for reasons such as suspected fraud, pricing errors, stock unavailability or breach of these Terms. If we cancel an order after payment, we will refund you in full.

5. Cancellation

You may request cancellation of an order before it has been dispatched by contacting info@decoharmonie.com. Once dispatched, the order is subject to our Refund Policy.

6. Product information

We take reasonable care to describe and photograph our products accurately. However, slight variations in colour, finish or dimensions may occur due to screen settings or the artisanal nature of certain designs. Such variations do not constitute a defect.

7. Intellectual property

All content on the Site - including text, images, logos, designs, graphics and software - is the property of DecoHarmonie or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify or commercially exploit any content without our prior written consent.

8. Acceptable use

You agree not to use the Site to:

Engage in any unlawful, fraudulent or harmful activity;
Attempt to gain unauthorised access to our systems or other users' accounts;

9. Limitation of liability

You agree to indemnify and hold harmless DecoHarmonie, its directors, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms or your unlawful use of the Site.

11. Force majeure

DecoHarmonie shall not be liable for any failure or delay in performing its obligations where such failure results from circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, strikes, carrier disruptions, government actions or internet outages.

Your personal information is handled in accordance with our Privacy Policy and the Australian Privacy Principles.

13. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of New South Wales. Nothing in this clause prevents you from exercising your rights under the ACL or lodging a complaint with a consumer protection authority.

We may update these Terms from time to time. The most recent version will always be available on the Site, with the date of the last update. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
